Who we are. “Company”, “we” and “us” mean Southern Advanced Plants Pty Ltd (ABN [ABN pending — to be added before this form goes live]), trading as Southern Plants™.
Who can enter. You must be 18 or older, and the photographer and copyright owner of each photo you submit. We can only accept submissions that meet these requirements, and may decline any that don't.
Our commitment. In exchange for the rights you grant below, we agree to review each eligible submission within 30 days of receiving it. If we first use a submitted photo — for example on our website, social media, or in our advertising or other business materials — we will send you one AU$10 Bunnings gift card within 30 days after that first use, using the contact details you provide. This is a one-off payment for that photo, regardless of how often or where it is subsequently used. We do not promise to use any photo.
Your copyright licence. You retain ownership of your copyright. From the time you tick the agreement box and submit this form, you grant us a non-exclusive, worldwide licence, for the entire duration of copyright including any extensions, to use, reproduce, store, publish, distribute, display, communicate, edit, alter, adapt and incorporate each submitted photo into materials for our garden feature and for the operation, promotion and marketing of our business, products and services — including our website, social media, paid advertising, marketing, packaging, catalogues, printed publications and other materials. We may also let our service providers, hosting and marketing platforms, and any business successor use the photo for these same purposes on our behalf. We will not sell or license your photos to unrelated businesses for their own, independent use. Except for the gift card described above, no royalties or further payment are payable for these uses, and no further approval from you is required. Subject to rights that cannot lawfully be excluded, this licence is irrevocable — you cannot withdraw it merely because you change your mind. This does not remove any right to terminate this agreement or seek another remedy on valid legal grounds, including for our breach, where the law provides that right.
Editing and attribution. You consent to us publishing your photo without identifying you as the photographer (unless you choose to be credited below); cropping, resizing, retouching and colour-adjusting it; adding or removing visual elements; and combining it with text, graphics or other images, including where this would otherwise affect your moral rights. We will not knowingly use or edit the photo in a defamatory or misleading way. This does not authorise falsely identifying someone else as the photographer.
Your assurances. You confirm you took each photo, own its copyright, and haven't granted rights that conflict with this agreement. If anyone else is identifiable in a photo, you must tell us using the question below — this agreement does not itself give us permission to use another person's image.
Privacy and legal rights. We collect and use the personal information in this form — your name, contact details, and anything identifiable in your photo — to review your submission, arrange the gift card, and credit you if you've asked to be. This is explained in our Photo Privacy Notice, including how to access or correct your information. Nothing here excludes rights or remedies that can't lawfully be excluded, or authorises an unlawful use of a photo or personal information.
Applicable law. This agreement is governed by the laws of Victoria and applicable Commonwealth laws, and the parties submit to the non-exclusive jurisdiction of the courts of Victoria.
